eXPressor - License Agreement

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS.

YOU AGREE THAT ALL OF THE TERMS AND CONDITIONS BELOW APPLY
TO YOU, IF YOU COPY, INSTALL, OR USE THIS COPY OF eXPressor SOFTWARE

IF YOU DO NOT AGREE, PLEASE TERMINATE INSTALLATION
IMMEDIATELY, AND DO NOT USE THIS SOFTWARE.

SOFTWARE COVERED BY THIS LICENSE
This license agreement ("Agreement") applies only to the version of the eXPressor software with which this Agreement is included, and license terms for later versions of eXPressor may also be changed.

LICENSE TYPES:

Home Use License
----------------
License for home users, which may want to pack some files at home. Packed applications cannot be used for any commercial purpose.

Individual Developer License
----------------------------
Serves to a single developer who wants to distribute his own applications. There is no restriction on the number of applications packed/protected distributed if you're the developer. eXPressor may be installed on maximum of 2 computers.

Corporate License
-----------------
Designed for organizations like companies or team of developers. The number of packed/protected products that can be distributed is unlimited. eXPressor may be installed on an unlimited number of computers.

NOTE:
You must acquire the license which is appropriate to your desired usage, described in each license type. All the licenses presented above include free updates for a full year and unlimited support. For Individual Developers or Companies (if instalation of eXPressor is desired on more computers) any additional HardwareIDs will be sent to us by email after registration; we will provide requested registration keys. Also, for any license type, it is the user's duty to ckeck/request for updates.

Trial License
-------------
If you don't own any other License this is the default one you receive. It allows you to use eXPressor for evaluation purposes only, for 30 days starting from the installation date. You cannot distribute, sell or rent applications compressed/packed with eXPressor. After 30 days you can buy the appropriate License or delete this program including all the files provided or created using eXPressor.

IN ANY TYPE OF LICENSE YOU MAY NOT:
-use eXPressor for other purposes that the ones specified inside your License (ie. use eXPressor on other hardware than company's computers "Corporate License");
-modify, reverse engineer, decompile or disassemble the eXPressor program;
-copy, distribute or share your registration key to others;
-sell or license copies of eXPressor to others;
-remove any proprietary notices or labels on eXPressor or any other CGSoftLabs software;
-use eXPressor in or for High Risk Activities (defined below);

YOU MAY:
-include the original distribution package (trial version) to CD's or DVD's for delivery (in its original state) with software magazines without express permission from CGSoftLabs;

TERMINATION.
The license will terminate automatically if you fail to comply with any of the limitations, conditions or obligations described herein. On termination, you must destroy all copies of the eXPressor software and all other materials in this eXPressor Original Distribution Package and, any or all of the files created by you using eXPressor and distributed to others.

HIGH RISK ACTIVITIES.
eXPressor is not fault-tolerant and is not designed, manufactured or intended for use or resale as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of eXPressor could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities").

NO WARRANTY.
Any use of the SOFTWARE PRODUCT is at your own risk. To the maximum extent permitted by applicable law, CGSoftLabs and its suppliers disclaim all warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
To the maximum extent permitted by applicable law, in no event shall CGSoftLabs or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT, even if CGSoftLabs has been advised of the possibility of such damages.

LIMITATION OF LIABILITY.
CGSoftLabs's entire liability and your exclusive remedy under this License Agreement shall not exceed your purchase price.
